A new class action lawsuit filed in New York City claims that Totally Cool misled customers by not warning that their products might be contaminated with listeria from ice cream.
Lawsuit Claims Totally Cool Hid Ice Cream Contamination
Leslie Price has sued Totally Cool Inc., saying the company didn’t warn people that their ice cream might be contaminated with listeria which can lead to very serious health problems for children aged and pregnant women.
The FDA says that if you have any recalled Totally Cool ice cream or sorbet, you should take it back to the store where you bought it.
Brands Made by Totally Cool
Totally Cool makes and sells these ice cream brands: Friendly’s, Abilyns Frozen Bakery, Hershey’s, Yelloh!, Jeni’s, Cumberland Farms, The Frozen Farmer, Marco, Chipwich, AMAFruits, Taharka, Dolcezza Gelato, and LaSalle.
Conclusion
The case Leslie Price v. Totally Cool Inc., Case No. 7:24-cv-04865, is real and not a scam. To get a refund, you need to take the recalled ice cream back to the store where you bought it. But Price says most people who find out their ice cream might be contaminated with listeria would probably just throw it away.
